D: Description of Services

I authorise the Certifier to perform all work necessary to comply with relevant statutory requirements, including: • inspecting the swimming pool • assessing whether the swimming pool complies with the requirements for the issue of a certificate of compliance under s.22D Swimming Pools Act 1992 • if the swimming pool complies, issuing a certificate of compliance to the Client • issuing the following if the swimming pool is non-compliant 1. Written notice under section 22E of the SP Act, indicating the items of non-compliance and 2. A certificate of non–compliance within seven days of the date of the inspection • Providing a copy of the section 22E written notice to the relevant local council: 1. Immediately where, in the opinion of the certifier, the pool poses a significant risk to public safety, or 2. Within 5 days after the expiry of six weeks from the date of inspection unless a certificate of compliance has been issued beforehand • if necessary, re-inspecting the swimming pool • updating the property record on the NSW Swimming Pool Register, as required.

E: Swimming Pool/Spa Inspection Fees: – Reinspection (within 6 weeks if required) – FREE of CHARGE – After 6 weeks new contract and initial inspection fee will apply

Standard Spa Inspection (within 7 days) – $220 incl gst
Standard Pool Inspection (within 7 days): – $357.50 incl gst
Drop everything Urgent Inspection – $495 incl gst

Note 1 – If Reinspection is required after 6 weeks – New contract and initial inspection fee will apply

F: Access to Property

I give permission to the certifier to enter the property for the purpose of inspection of the swimming pool and consent to the certifier taking photographs of the pool area

Note – Change in Legislation

I/We acknowledge the following: – The NSW Department of Fair trading has advised Pool Inspectors that all pools must now be assessed under the current Australian Standards AS 1926.1-2012 unless the inspecting Certifier has documentary evidence of a pool and barrier existing in place on 31st August 2008 and also to have documents showing that it was, on that date fully compliant with AS1926-1986 and Part2 of the Swimming Pools Regulations 1998. If at an inspection, a barrier is found to be non-compliant with AS 1926-1986 or Part 2 of SP Regulations 1998, a Certificate of Compliance cannot be issued. This applies even if fixing the barriers non-compliance doesn’t involve the barrier being substantially altered or rebuilt.

H: Declaration

I/we have read and agree to this Declaration: – 1. I have freely chosen to engage the above NSW E1 accredited certifier and 2. I have read the contract and any accompanying document – Information about registered certifiers – Swimming Pool Certifiers under section 31(2) of the Building and Development Certifiers Act 2018 and Cl 31 of the Building and Development Certifiers Regulations 2020 and understand my responsibilities and those of the certifier. 3. I acknowledge that Pool Owners who want to comply should be aware of the changes in legislation with the introduction of the Swimming Pools Regulations 2018 and as such their pool enclosure may be required to be upgraded to AS1926.1-2012 requirements.

I: Swimming Pool Barrier Contract/Agreement

By agreeing to this Agreement, You declare that: a. You have freely chosen to engage the Certifier as the certifier of the Pool and b. You have read this Agreement and all documents accompanying this agreement (including without limitation the Information Sheet) and You understand the roles and responsibilities of Yourself and the Certifier. Where this agreement is agreed upon by an agent, solicitor or conveyancer for and on behalf of the owner of the Pool, the agent, solicitor or conveyancer by his agreement represents and warrants that he has full authority to enter into this agreement on behalf of and so as to be binding on the owner of the Pool.
